@lilrobda1 Also, no Lilrobda1, I think I know why you ask me if I've been gaming 24 years. Let me break it down for you, 24 years ago it was 1989, not 1972. I have only seen pictures of the Magnavox Oddyssey. I don't know anyone that owns one that still works, and that console was the first game console. I never said the NES was the first home game console. I am not going to reiterate what I said, so if you want to read it again to clarify, go for it. Considering I wasn't even born in 1972, and considering the console was 16 years old when Nintendo launched the NES, I am a little confused how Nintendo managed to copy them. The joystick in general from what I understand, has been around even longer than that and the N64 definitely didn't copy off of the Magnavox Odyssey. By your logic, no one was aloud to add joysticks to their controller(s) because Magnavox, a company that was practically non-existent when the N64 launched, created it first...I'm sorry...but I fail to see your point in all of this..I would hardly call a console that came out almost 30 years later with a thumb stick controller, copying.
It is a patent though, so maybe Magnavox should sue every company for mimicking a controller that is similar to the one they created back in 1972. Next year we'll see Magnavox game consoles back in the market...
@BradBurns I don't feel they owe him anything, he should have come forward when the 3ds launched first of all. Second of all, he obviously didn't have them sign any documentation that stated they couldn't build this tech with their own money. This is another annoying lawsuit over patents. Think about it, at this point in life, it is very difficult to invent something that hasn't already been invented before. I'm sure every piece of tech that we have seen the last 10 years has just been old ideas with a decent budget thrown at them. If these patent wars keep up, companies will eventually thrive off of suing each other and the consumers (us) won't really be the ones any longer who control how much they make off their products.
@BradBurns I think your analysis of this is very well thought out, however, I am unclear how you feel about it. Both of these individuals, had an idea, and they both presented it to Billion Dollar Corporations. They didn't take the time however, to have either corporation sign any waivers that restricts the use of the individual's content without his/her consent. In today's world, that documentation is extremely important when anyone has an idea, because it is really easy for people to pass other's ideas off as their own. As individuals, we need to cover our own arses when we present "the next big thing," to businesses. Instead, we generally pitch an idea to a company without even considering the alternatives, and if backstabbing happens, we get upset and try to turn it into a patent war or (insert lawsuit here). It is ridiculous and it is bad for business...because it kills innovation and new ideas.
@Thanatos2k I'm sorry, I didn't realize you were sitting in the courtroom with all the facts in front of you to make that decision. This isn't "fanboyism" (read my other comments). It is a simple response to ignorance from people like yourself who just want to bash on a console for no reason. I don't care if the lawsuit holds water in the courtroom, my main point I have been making this whole time is I think patents are stupid, and feel that companies and people shouldn't have the right to create a lawsuit over them. Ultimately, if this guy, or anyone for that matter wants to create something that is innovative in it's own right, they should apply for a job, and then share their ideas with the company...either that or take out a huge loan and market the idea yourself until you have a buyer of that idea. Nothing is for free in this world and if people are too ignorant to cover all their "bases" before producing something, then they don't deserve a penny. If you invented something, would you present it to a corporation and expect them not to take notes or look at the code or hardware be hind it so that they could replicate it and try to make it better? It is a matter of collecting paper work and selling your idea and getting someone to sign a waiver that says they can't copy, or infringe what you are presenting to them should they appear to be uninterested. This individual didn't do that, he waited patiently for someone else to put the funding into the tech and then he spoke up once he realized there was a market for it. Why didn't this guy step forward when the 3ds first launched? Why wait til now? You my friend, are clouded with ANTI-Nintendo bias and the only "fanboy" here is you. I love all consoles...and I don't feel that Nintendo as a company, is any less important than Microsoft or Sony. Each has a significant role in the gaming industry, you should try to embrace it, it is only a good thing for gamers like ourselves.
@hystavito I don't know which people you're referring to. I will say that most of the time when Eddie write a column on Ninty, it is negative. Is he sourcing other information in his article? Sure, but the information he refers to is always negative, and its only a fact by opinion. What kills me is many people read this and say, "Ninty is going bye bye," when in fact, Ninty is doing just fine. Their project sales of this console are a bit short and if you ask me that is mainly do to their lack of marketing and overconfidence. Sony made this exact same mistake when they launched the PS3 and it is doing fine now. Trust me when I say this console will be around for another 3-5 years and will have plenty of titles that will make it worth owning, even if you hate Nintendo.
The sooner people like yourself get away from these stupid stereotypical kid comments, the sooner people like yourself will start appreciating a good game. It is a game, play it for enjoyment and try not to judge it by what audience it appeals most to. People like you kill me with your, "oh its for kids" comments...who cares?! If its fun and addicting, that should be what counts.
@GamerofMario1 Nintendo basically dropped the ball on this "itch" because they probably didn't take this guy seriously when he first approached them like any big billion dollar corporation. Now he has their attention, and hopefully it doesn't backfire on him....

Also, N64 came out and had a joystick and the ORIGINAL PSX controllers had no joystick. Sony took that "patent" and named it "Dual Shock." Want another? How about the PlayStation Move? Yet Ninty hasn't picked at Sony, and my honest opinion? Sony took something that Ninty made, and made it better...I'm not taking away from Sony but I also am not going to sit here and read a bunch of "Nintendo is copying people" bullcrap...because it just simply isn't true.
