EA Origin EULA sparks privacy concerns

Mandatory licensing agreement for online service appears to indicate publisher can monitor, pass on data on all software installed on users' PC.

Electronic Arts has been investing heavily in online distribution and connected gaming over the past few years, and one of the biggest of those investments is its new service, Origin. A full-on replacement for the EA Store, Origin serves as a hub and infrastructure for downloading and playing PC games, as well as ordering boxed products for other platforms.

However, speculation has arisen that Origin serves as a clandestine way for EA to intrude upon users' privacy. Posting to The Escapist's message boards, forum user Dirty Hipsters called out Origin's End User Licensing Agreement, claiming that not only does the verbiage allow EA to "monitor your PC and to make a profile of you," but also detect "illegally downloaded material" and see what websites have been viewed.

Consulting Origin's EULA, the passage in question can be found in Sections 2 and 3, titled "Consent to Collection and Use of Data" and "Application Communications and Conduct/Privacy Settings," respectively. When EA refers to the "Application" in this context, EA notes that it is in reference to Origin and all related software, documentation, and updates.

"You agree that EA may collect, use, store and transmit technical and related information that identifies your computer (including the Internet Protocol Address), operating system, Application usage (including but not limited to successful installation and/or removal), software, software usage and peripheral hardware, that may be gathered periodically to facilitate the provision of software updates, dynamically served content, product support and other services to you, including online services," Section 2 reads.

"EA may also use this information combined with personal information for marketing purposes and to improve our products and services," the section continues. "We may also share that data with our third party service providers in a form that does not personally identify you."

The Section 3 passage reads: "EA reserves the right to monitor communications on the Application and disclose any information EA deems necessary to (i) ensure your compliance with this License; (ii) satisfy any applicable law, regulation or legal process; (iii) protect the rights, property and interests of EA, its employees or the public. EA also reserves the right to edit, refuse to transfer and/or to remove any information or materials, in whole or in part, in EA's sole discretion."

The EULA goes on to note that if users do not agree to EA's collection of this type of data, they should not install the application. It also says that this data is being used in accordance with EA's privacy policy, which among other statements, states that, "EA will never share your personal information with third parties without your consent." However, it is unclear how EA's privacy policy is compatible with the rights reserved in Section 3 of Origin's EULA, if at all.

As with most legal language, the extent to which EA is able to use this EULA to monitor users is open to interpretation. However, the EULA is markedly different from EA's standard PC software agreement. For EA's standard PC EULA, the "Consent to Use of Data" section is more narrowly confined to "technical and related information that identifies your computer (including an Internet Protocol Address and hardware identification), operating system and application software and peripheral hardware."

The addition of the "software, software usage" verbiage could be interpreted as including the ability to monitor any installed program, regardless of its provenance. EA's Origin EULA also adds the right for the publisher to share whatever it finds with anyone it chooses.

EA has run into privacy concerns in the past. Most notably, in 2006, the publisher first revealed that it had begun collecting users' data as a way to target and deliver in-game advertisements to players.

EA had not responded to GameSpot's request for comment on the matter as of press time.

@Rovelius Totally. I mean, if only Steam did a better job of letting EA "communicate directly with it's customers." Because that's what an open platform should do, provide a direct platform of communication for people to sell you stuff. And here I thought email and ingame notifiers was enough... shows what I know! ;)

@firehawk998 - I was only joking about the bad publicity thing (: Like I said - I agree with you. But there's still time until BF3 comes out, so they could still change the EULA, and then we'll know it really was just a publicity stunt (or just a veeery bad decision). Edit: just noticed XanderZane's comment. Didn't get to read the new version though. Interesting :)

But this news has done EA damage. *********************************************************** They probably changed the wording, but I doubt they change the application and I bet it will still collect data of your PC without your permission.

Only EA PC game I have is Dragon Age and I haven't even loaded it yet. If I decided to load and play the game, I'm unplugging my internet connection first. lol!! If it doesn't run because it's looking for the internet, I'll uninstall it and sell it on EBay. lol!! I hate companies that feel they need to search your system for data and other personal information. How does this effect people who don't even have internet access? If I want to play EA games, but don't have any internet connection at all, how would I be able to play their games? Does EA even have an answer for that?

just keep doing it EA, keep ruining one of the most impressive and expected games of the year, poor DICE and bf3, they ve worked so hard and listened to fan's every concern in almost any game this would make me not buy it, but i've waited too long for bf3, i like what ive seen too much, and for that i know not playing it is gonna be much worse than having to use origin. i dont like ea and its origin, but you gotta know when to back down, however i do sugest casual buyers to screw ea a not buy shlt

@Richardthe3rd Steam allows instant game updates, cheating protection, ingame reports thru the Steam overlay and many more features for devs all free of charge. Obviously that's what he meant. EA sucks so bad.

EA selling Spyware in form of a game. Ubisoft enforcing DRM that requires internet connection on games like From Dust even though they said they won't. Gamestop shamelessly opening Deus Ex PC cases to remove OnLive coupons. Crytek lying that Crysis 2 would have dx11 at launch,even though it didn't. Is it just me,or something really phukt up's going on latelly o_O

@Snow_Girl:- look I know the saying any publicity is good publicity but when you are in investing millions of dollars in a game to defeat the sales behemoth that is the COD series. The last thing EA wants is bad publicity like this. Before the Origins and now this crap if you asked people here would they buy BF3 most of them would immediately say yes but after this story ask the same question now there will be cautious or negative response . If EA does not change its EULA before the game gets released BF3 will fail.

Well, this is quite unnerving. Even if you're a legitimate, respectable PC user/gamer, the invasion of privacy with all the cards stacked in EA's favor makes this a very, VERY troubling sign. Shame on them. Of course, all the legal jargon (pages and pages and pages of it) is specifically worded in a way that grants them full power while making it as confusing as possible to the person wanting to use their service. It's either "accept" or "you can't use it". Honestly, can anyone sit down and read aaaaaaaaall that info and understand it without their head exploding? lol

Y'know....Life does NOT end if you don't buy BF3 or TOR (2 games i firmly had in my sights too). gwailo2470 is right...This IS what they do. And have done for the past decade. @gwailo2470 I know they did this before with Battlefield 2142. But the eyes are uppon them. When they change the EULA again for the worst I'm sure we'll hear about it. We will complain again, EA will feel it will lose money and change it back again. But some of the people here go a bit to far with the "EA HAS ALWAYS BEEN A EVIL CORPORATION BEND ON DESTROYING OUR LIVES TO GET A PROFIT.".

So where are the fanboys now? People were so starry eyed about BF3, they hated on anyone pointing out the evil that is EA is going to screw them over. This is EA. This is what they do. @Damnation_6 If you think this means the problem is over, you're seriously naive. They're just going to change the EULA in an update once this dies down. The only point of having origin is to do exactly what the article above describes. They want to have access to ALL the data on your computer so they can sell it. They have tried it before and they will try it again.

If you want to contact someone at EA and express yourself and tell them your cancelling preorders of games etc here is a list of email addresses. << LINK REMOVED >> i think this should be spread to everyone who has any interest in any EA game its the only way this will be stopped. Also this article doesn't state that even if you uninstall origin EA can still go through your computer

Well, that prompted me to remove Origin from my system. I will keep my Battlefield 3 pre-order for now, but will cancel it if I don't see anything about this being removed. I hope Star Wars The Old Republic doesn't require Origin to play as well, or I will cancel my pre-order of the CE before it comes out as well. I'll keep an eye out on this for now, and they have till a week before Battlefield 3 comes out to correct this or I will start keeping an eye out for anything with Origin attached to it and probably avoid EA like I avoid Activision/Blizzard, and Ubisoft.

EA is really starting to annoy a lot of people with their online policies LOL Pretty scary to think that they have people sitting there sifting through your entire PC history and picking and choosing what they want to share with others or not. People shouldn't have to be worried while playing video games that someone is looking into my stuff and using it as they please.

So what's next? My car won't start, even if I have the key, without inserting an authentic copy of the invoice into a built-in security device, and allowing it to take DNA samples as a proof of identity, and the car will monitor my position, and I will have to consent to having a radio set installed in the dashboard that cannot be turned off and blares advertisements depending on my position? When paying customers are inconvenienced and treated like inmates who have to be monitored around the clock while pirates enjoy the freedom and privacy that should be the God given right of the paying customer, any attempt to fight illegal downloads is futile.

Now that I think about it, this really pisses me off. I have BFBC2, Crysis 2, and Medal of Honor that I bought from those bastards, and now I can't play them without agreeing to this crap. Second boot-able partition just to play these games? ugh.

Well i am officially never buying an EA product again and even though i never liked their business tactics....this is going to suck. No matter how much i can say i hate EA's influence they have over all of the great I.P.s and developers they seem to suck into their blackhole i can't help but love some of their games. @jamyskis People don't like to read the fine print and there are multiple reasons for it. Mainly, it is purposefully made obfuscated so you almost need an article like this or a person disciplined in that form of law writing to explain it to someone who is not. Frankly, i feel bad for all of the people they'll be completely invading and most of them won't even know it. This is wrong...no matter anyway EA tries to angle it.

And that is why they pulled their products from Steam. I was going to pre-order Battlefield 3. Not no mo'. EA is really trying hard to alienate gamers. Can whoever hacked PSN hack EA as well, just to teach them a lesson.

uh-oh! Porn alert! you're going to know that "someone" in your household has been surfing sites and using programs to hit the more questionable websites, when you're half way through Battlefield or Mass Effect's campaigns and your pitched an "in game" advert for viagra! I find it a real shame now that I will be buying battlefield exclusively for 360. gaming - IMO - should be at least one of the places none of us should have to worry about our privacy being intruded upon. I'd like to say a BIG thank you to the chap who had called EA out about this detail in their agreement. kind of depressing really.

Let's expand the comment to cover all publishers though. We as gamers need, indeed we are required, to act like customers - which means playing a little more hard to get and making sure we get a good deal. I seriously worry about people who just sheepishly buy games like Battlefield 3 in spite of dodgy EULAs because they can't live without their headshotz. It's a clear indication of a serious lack of fundamental life skills. In a world which is ruled by the word of law, people need to learn to read the small print.

Is EA becoming Big Brother? Come on now we all knew this was coming as technlogy has evolved. How many companies out there are actually monitoring us w/o the fine print. At least EA put it in writing and allowing us to make an informed decision. I do not like it, but we do have a choice to buy or not to buy. If you are against it do not buy their products. I do want a choice if I want to or not to receive thier solictations and they just thrown it in like a piggy back bill and we do not have that choice. Not a good move on their part.
