UFC parent sues Ubisoft

Zuffa claims use of term "ultimate fighting" on Fighters Uncaged packaging violates trademark.

A month after it released Fighters Uncaged for the Xbox 360's Kinect motion-sensing system, Ubisoft has a legal tussle on its hands. Last week, Ultimate Fighting Championship parent company Zuffa LLC filed a lawsuit in the US District Court in Nevada against the French publisher's US arm, based in California.

According to the suit, Zuffa is taking issue with Fighters Uncaged's packaging, which bears the term "ULTIMATE FIGHTING" in all capital letters on its back cover--a term that the company has trademarked. "[The] defendant's use of the ULTIMATE FIGHTING name and mark is identical or confusingly similar to the use of the UFC® marks, including the ULTIMATE FIGHTING® name and mark on Zuffa's licensed video games." THQ publishes the official UFC games and recently signed an exclusivity deal through 2018 with the company.

The suit continues, "By using the words ULTIMATE FIGHTING® and setting them all apart in capital letters, [the] Defendant is creating or attempting to create an association between its product, 'Fighters Uncaged' and the UFC®. By using the ULTIMATE FIGHTING® name and mark on its video game, [the] Defendant is attempting to trade on the goodwill of the UFC®."

Furthermore, Zuffa has taken umbrage to Fighters Uncaged's setting, which is the world of illegal street fighting. In its complaint, Zuffa lays out its years-long effort to make mixed martial arts a respected sport. It points out that when the company took over the UFC brand in 2001, MMA was banned in most states, but it's now sanctioned in 44 of the 50 states in the union.

Zuffa believes that it has suffered "monetary damages" and "irreparable injury to its business, reputation, and goodwill" as a result of Ubisoft's use of the term "ultimate fighting" on Fighters Uncaged's packaging. The company wants the publisher to be prevented from further using the term "ultimate fighting" and wants all packaging that uses the term to be destroyed. Zuffa is also seeking all profits Ubisoft may have made from the game, as well as attorney's fees, exemplary damages, compensatory damages, and triple the normal damages for trademark violation.

Poor Ubisoft, not only did they release a garbage game that sold pretty much nothing, now they're getting royally sued for doing so. Just goes to show, Kinect doesn't pay :D

Stupid lawsuit from a stupid company. Ultimate Mortal Kombat 3 also used the Ultimate Fighting words too. It seems someone at UFC just wants some quick cash. I don't see why using the phrase could be copyright infringe.

Gaming Corporations are suing each other all the time, most of the stuff just doesnt get a lot of publicity because it happens so often. It is usually over technical stuff like gameplay mechanics. Disputed "trademark rip-offs" usually make bigger news.

Furthermore the worse thing that can happen is Ubisoft will be forced to take the phrase Ultimate Fighting off of the packaging. Whether you like them or not UFC is a legitimate brand and they have to protect theirs like everybody else.

well first of all, the ufc is a joke. i dont know where they think they get this "respect" from. And second, im not a fan of ubisoft either, i think most of their games are horrible, ESPECIALLY fighters uncaged, but they should be able to put a two word slogan on a game thats pretty generic.

Zuffa...your everything wrong with modern cage fighting..more ads than F1,silly contract clauses and taking a hissy fit bout a game going toe to toe with yours and some ex-fighters being in the other game. Go cry somewhere else.Still lozly they want to sue over 2 words...lets really see how this holds up in court.

I would think the lawyers behind the lawsuit would not have brought it forth if they didn't have enough grounds for it. Knowledge I believe most people here do not have about the world of copyright patent lawsuits. Just something to think about before we all start acting like we're lawyers.

Lmao they think they can win this just for 2 words on the back cover and expect 100% of the profits and extra's ?, someone's very stupid or extremely confident....proberly both. Most "Ultimate" versions of a genre arent all that great, but i hope Ubisoft has fun tearin them apart in court :D

What a joke,the word ultimate can be put before almost any word to help sell a product; example: "The ultimate RPG experience" . If ut had anything to do with the UFC it wouldn't all be in capitals or not include Championship at the end. Greedy people making silly accusations.

"I was too far away from that strike." "Could have dodged that strike." What is this? It reminds me of the 'thoughts' inside your [character] head in Heavy Rain - except it went well in that game. WOW.... "THQ publishes the official UFC games and recently signed an exclusivity deal through 2018 with the company." it's not related to said topic BUT that saddens me since the UFC games are going to suck until the 2018 deal is over.. THQ has proven that it is an old dog that doesnt learn new tricks take the Smackdown vs Raw franchise for example...

Unreal. These losers went after Spike for using something that resembled their stupid UFC cage in Fire Pro D. That was even before their little reality show put them on the map. Zuffa is out of control. Why don't they focus on putting together good fights and getting the best fighters in the world to fight in their organization instead of spending money on all of this super-protectionist paranoia? The UFC reminds me more and more of the WWE every day!

I'm a big fan of the UFC, and I admit to thinking of them when i saw the packaging for Fighters Uncaged. But be reasonable. The game tanked. No-one bought it. It got trashed by reviewers. And it's simply crap. How are you going to sue for the profits of a game that made none. Zuffa are muppets. the lot of them. And "monetary loss"? How? I don't understand how a crappy video game can lead to losing money for another company. Did you also see improved revenue when Street Fighter added an MMA fighter? I think NOT!
