Bethesda puts Fallout IP in vault

Three years after landing the rights to the futuristic RPG series, Oblivion developer now owns the property itself; Interplay to continue with Fallout-branded MMOG.

It's been long known that Bethesda Softworks is working on the post-apocalyptic sci-fi role-playing game Fallout 3--which is rumoured to be coming to the Xbox 360--some might have forgotten that Interplay is also planning a Fallout massively multiplayer online game, due in 2010.

According to a Securities and Exchange Commission ruling this week uncovered by fan site No Mutants Allowed, Bethesda has bought the exclusive rights to the Fallout brand, for a sum of $5.75 million. Previously, the company had only licensed the rights to make a game, while Interplay retained ownership of the Fallout IP.

Under the terms of the agreement, Interplay will still be allowed to go ahead with its MMOG game, although "all the rights, titles, and interest" to Fallout are now the sole property of Bethesda. So, in essence, now Interplay is licensing the Fallout MMOG rights from Bethesda.

Under the terms of the deal, the Fallout MMOG will be not playable in a single-player mode or offline in any way--it will require some kind of monthly subscription, and a minimum of 10,000 subscribers. On top of that, the license specifically states that the game must only be for non-console platforms like the PC or Mac, and not use any console online services such as Xbox Live.

The Fallout MMOG might not be out until around 2013, however. The contract states that the project must be commercially launched within four years of the development commencement date, which could start any time within the next two years.

The original game, Fallout, was released in 1997 for the PC as an unofficial sequel to the 1987 game Wasteland. It was set after a series of nuclear explosions had devastated the world and people survived by living in huge underground vaults. A sequel, Fallout 2, followed in 1998, along with various spin-offs, including Fallout: Brotherhood of Steel for the Xbox and PlayStation 2 in 2004.

Phew, that title gave me shivers for a moment, I thought Bethesda were going to discontinue development on the Fallout game indefinitely. Bad bad Gamespot making me worry like that.

Well gavin, you are going to be sick and tired for a loonng time. Oblivion was a great game and a lot of people are going to say it is the best RPG. It isnt as if Fallout was any different, all games have a limited plot direction.

I'm SICK and TIRED of people considering Oblivion to be the best RPG there ever was,yes, you can travel around in oblivion and do what you what, but do you actually have any kind of CHOICE in the game apart from where you want to go? You cant choose how you can go different ways in a quest, the point of the whole damn game is to kill everything for god's sake, the "talking" system is a crappy simon says kind of type of game and the dialouge is frankly horrible.

Looks like we can look forward to a Fallout 3, 4, 5, ........ and so on. I wonder if Interplay will be able to properly make a Fallout online. As far as I know they have never made an MMO and they no longer have any original fallout developers.

Looks like Bethesda is serious about making another Fallout. This is good news for the legions of fans of the Fallout series (me included). This calms my nerves about the upcoming Fallout game, I was pretty nervous there for a while. We'll just have to wait and see . . .

The only game franchise I like more than the elderscrolls when it comes to role playing games, is fallout (BoS excluded). Ted Bundy take you, Bethesda, if you **** this one up. Fallout 3 is higher up on my list than even diablo3, and that's saying a lot. as a matter of fact, it's my "everything" number one, bar halo3. May the Mad Max be with you, always.

Hmm... Fallout 3.. yeah! my most awaited game! although Bethesda had a lot of bad critics, i sure hope they can come out with a good sequel (FALLOUT 3) without destroying the game plot. Good luck Bethesda! hopefully Fallout 3 will be released soon!

I hope Bethesda learns from its mistakes in ES4 (especially... leveling creatures) and does well inr etaining the fallout feel from the first two games... As for the MMO, Interplay is in tens of millions of debt, has declared bankruptcy, has no employees, and former employees are suing for not getting their pay. Even after this deal, I doubt a Fallout mmo will happen.

Don't worry zsc4 I doubt they will ruin it. Bethesda is really good at creating open ended RPG games like what Fallout was. It will probably be awesome!

I don't care how well they've done with Elder Scrolls, they'd better not mess up Fallout, otherwise I'll hate them so much and curse them forever. and they'd better release it on PC because that's where it started.

This is bad. 'The contract states that the project must be commercially launched within four years of the development commencement date' MMO launches are always tricky, and the player base should be understanding, but put a finish date on an MMO just makes things worse. I hope this doesn't go bad. And yes, if Bethesda makes Fallout like it ruined Elder Scrolls, it will be a sad sad day for Fallout. Hopefully though, Obscuro will make an awesome mod for that too.

JEEZE, 5.75 million. and black isle studios won't see a penny, even though it's THEIR blood and sweat and creativity, not interplay's. and the way interplay is going they're just going to waste it on their dubious debts and continue to shoot out even worse games than late.

Somehow Interplay has managed to barely hold on all this time. I'd say selling off properties they can't afford the entire development cost for might help them regain market share. It's kind of like how Conspiracy Entertainment has begun to build momentum again. Selling the US publishing rights on ChoroQ to Atlus helped them quite a bit. Check out Ultimate Block Party, I haven't played that game yet.

Man, I too was about to have a heart attack from reading the title of this thread. I think Bethesda will do good. Clearly, if they are shelling out cash for a franchise, they are extremely serious in making a workable Fallout game. I can't wait to play it!

Oh, I forgot one thing. At present, Fallout 3 is a COMPUTER game not a console game. There was a slip up by a Bethsda spokesperson that stirred up all sorts of rumors, but there is no official word of any kind that Fallout 3 will ever make it to the Xbox 360, PS3 or any other console for that matter. Just like there is no official word it will take place on the East Coast, be first person/real time, or any of the the other crap you've heard. So be smarter than the average dumbass and don't believe everything you read...... except this of course :)

Just to clarify... Anyone who has kept up on the Interplay charade the past few years would know there is little to no chance a Fallout MMO will ever be produced by Interplay. Their CEO Herv Caen has apparently bankrupted the company and sold Fallout to Bethesda to hold off his imminent downfall. Now, as for Bethesda taking over the Fallout IP, I honestly cannot see why anyone would scream and shout so much. Before Bethesda stepped in and paid a tremendous investment cost ($5.75 million!), Fallout 3 or any future Fallout game seemed a pipe dream. A lot of people complain that companies consisting of orignal Fallout creators (the recently bankrupted Troika, Obsidian, etc.) didn't get a crack at making Fallout 3, but it's pretty clear none of them had the time or funding to do so. I couldn't pick a better company to carry on the Fallout torch and yes it's not going to be the original Fallout, but what can anyone expect. Oh and don't try the typical "Bethesda is just going to make Oblivion with guns" crap. I know Bethesda knows the consequences of trying something like that and if they really wanted to make "Oblivion with guns" why did they spend $5.75 miliion to purchase the Fallout IP when theyh could have made their own original Post Nuclear Role Playing Game? Ok, enough of my ranting, I just hope I've made my point.

Fallout...what a good series,but I think it's coming to its fall...well depending on the case,could be a major fall or minor fall.Why back out of the consoles?There's a lot of things that happened behind the report above that determined that.Overall, though,it will only sell more copies if the game goes console exclusive(better for me,360 exclusive:)) Just one thing to say, Chainblast,I own a 360 and it makes a moderate amount of noise,but when your playing a game at even low volume,you're not going to hear the beast:pYou probably just tried it at Gamespot,witnessing that overheating that goes on in an enclosed display box(by the way,you can here the demo PS3 sytem throughout the whole store lol).No fanboys comeon,both systems are great,personally I like the 360 more because of the games, but if Sony gets some more deals for some better games?I'm all for it.Back to Gears of War,I'm missing the blood.

@fastpunk Yeah. Most likely, this won't be the Fallout we remember, but a series needs to constantly reinvent itself if it wants to be successful for a prolonged period of time. We already have two classics - two masterpieces - in the franchise. Why not take some risks? I have a feeling that it will be perhaps more similar than we might think, given the strong fan reaction to major change, and the many forceful opinions floating around the internet.

I'll take Fallout 3 over a Fallout MMO any day. I just hope they release Fallout 3 for PS3 because I have no interest in buying a jet engine. Seriously, the X360 makes more **** noise than my PC, which is quite beefy.

Play Fallout 1 and 2; then make commentary. They are 2 of the best Computer RPGs ever made. Great stories voice acting and gameplay. Do not right off a game because you think teh genre is stale. What genre isn't stale anyway? Very little can be called original anymore. What should be looked at is how well something is executed. Interplay/ Black Isle executed very well and still influence many games and developers. Games like S.T.A.L.K.E.R. use so many elements of the Fallout brand that I forgot I'm not playing a fallout shooter most of the time. Until everyone start screaming in russian anyway.

@fugori: Yes, I agree. They approach the story element in a different way. I guess it's a matter of taste. I, for one, usually choose something a bit more linear (but with great characters) over an open-ended RPG like ES. Or better said, I prefer a game that is more focused, I think that's the best way to put it. As for Fallout 3: there is no doubt it will be good but it will not feel like Fallout because you got to admit Black Isle had style,a very unique style, that is very (if not impossible) to reproduce... and for a game that has Black Isle written all over it, it's almost certain death when you change the developer, it's like taking the soul away and putting in a new one (which might be brilliant but it's not the same).

well at least it wasn't the "not make any game for it now that we own the rights" kind of vault that the article made me beleive.....so here's hoping that Fallout 3 actually comes down the pipe soon.....the MMOG on the other hand looks like it will be a fruitless endeavor as so many end up being

I think today is probably the day where there is the most screams on Internet ever, I'm pretty sure majority of the Fallout fans is screaming big times out there now... LOL, I think this is good, I loved oblivion myself, never liked fallout, maybe they make something good out of it.
