Gearbox sues over new Duke Nukem

Gearbox has taken legal action following the launch of a Duke Nukem: Mass Destruction teaser site.

Current owner of the Duke Nukem IP Gearbox Software has filed suit against Apogee Software and Interceptor Entertainment over the companies' intentions to release Duke Nukem: Mass Destruction.

Earlier this month, Interceptor Entertainment, the developer of the recent Rise of the Triad remake, and 3D Realms launched a teaser website for Duke Nukem: Mass Destruction, a top-down action role-playing game for PC and PlayStation. The site was counting down to Feb. 25, but the countdown clock has since been obscured with a fake emergency broadcast signal.

3D Realms, whose logo appears on the website, exists today in name only, after being effectively closed in 2009. The studio's legal name is now Apogee Software.

The suit, filed in Texas, shows that Gearbox is seeking damages for trademark and copyright infringement, which “stems from efforts to illegally exploit Gearbox’s intellectual property rights in the Duke Nukem video game franchise.”

“You and 3DR are colluding with other, equally-unauthorized parties to develop a new video game based upon the Duke Nukem IP,” Gearbox’s lawyers said in a cease and desist letter to 3D Realms’ CEO Scott Miller. “No developer reveres Duke Nukem and its fans more than Gearbox; it’s why Gearbox committed so much to rescuing Duke back in 2010. As you well know: 3DR’s rights were reduced under the terms of that rescue, not expanded.”

3D Realms’ Scott Miller and George Broussard responded to the letter with a signed document that acknowledges Gearbox’s rights for the Duke Nukem IP. But unless we’re supposed to understand the emergency signal on the teaser website as a cancellation notice, it seems as if Duke Nukem: Mass Destruction is still going forward.

Gearbox’s Steve Gibson told Polygon that the current lawsuit is simply a formality and that he's confident Gearbox will succeed. “We tried to avoid court,” he said.

In 2010, the Borderlands developer announced it acquired the rights for the Duke Nukem IP. It helped see Duke Nukem Forever to the finish line after more than a decade in development, and announced plans to develop other games in the franchise.

"Gearbox was the only home appropriate for the Duke Nukem brand," Broussard said at the time. "They are very talented and possess the perfect perspective and understanding of the brand. Their vision for its future direction is exciting and unbelievable. I personally cannot wait for fans to see their unique take on the franchise."

In 2013, 3D Realms sued Gearbox alleging unpaid Duke Nukem Forever royalties, but then abandoned its claim, and apologized for what it called a “misunderstanding.”

If it is based on principle Gearbox has every right to sue, but it is a shame they put out a crappy game that took years to come to life. They can come to an agreement where all parties are happy.

If this gets all muddled up in the courts, no one can release anything until the litigation is resolved, and the way American courts work that could be a looooooooong time.


Gamers don't win when any game IP gets litigated.

I was thankful and happy to actually get something but then not sure if I was supposed to be upset as to my expectations of the "quality". When I look back at "forever" and picture it as it was done by say a larger indie team I think a lot of people would have thought about it differently. I don't think it was a bad game..but many things were really making it difficult to not become one.
But even with that said, I would rather nothing came out ever again than to have duke show up in any worse shape in any form compared to "forever". Don't want to see him die, but hes not designed to suffer either.

It's in Gearbox's right to sue. But with that being said, a lawsuit's merit is based on damages done. Heh. What damage could this new Duke Nukem do to Gearbox that they haven't already done to themselves?

@jhcho2 Not necessarily. GB could be seeking an injunction against making the game in the first place. There would be grounds for that if they can establish an imminent release of a product that could impinge on their IP.

I know that. But the principle of infringement works based on one guy making money off another guy's IP, and therefore indirectly (or directly) denying the victim potential revenue. I'm just saying it's hard to picture Gearbox as being a victim of anything other than their own actions.

Committed so much to resucing Duke in 2010??? You rehashed a build that had been around since 1999 for the 3rd time in its development cycle and then packed it and sold it! And while I enjoyed it as a game, IT SUCKED AS A DUKE TITLE. Sadly this is just a pure IP issue and Gearbox DOES have those rights. I can't be mad at them for something that really is a clear legal situation. This isn't corporate bullying or legal trickery like is usual in this industry, this is legit IP ownership rights. Hopefully they can come to a deal instead of just shutting them down, Gearbox clearly cannot make a good Duke so they should just let others run wild with it. I'm sure if it was turned open IP the community would crank out a better DN in two years.

I'm obviously in the minority, but Duke Nukem Forever was a great game to me. I still play it all the time both on 360 and PC. The DLC The Doctor Who Cloned Me was great fun too. Dukes personality, humor, and satire is what made the game for me. Gearbox didn't make the game. 3d Realms did. Gearbox helped them cross the finish line and put the game on the shelf. Colonial Marines is another story all together. I didn't even get the same game the trailer indicated at all.
