Gearbox sues over new Duke Nukem

Gearbox has taken legal action following the launch of a Duke Nukem: Mass Destruction teaser site.

Current owner of the Duke Nukem IP Gearbox Software has filed suit against Apogee Software and Interceptor Entertainment over the companies' intentions to release Duke Nukem: Mass Destruction.

Earlier this month, Interceptor Entertainment, the developer of the recent Rise of the Triad remake, and 3D Realms launched a teaser website for Duke Nukem: Mass Destruction, a top-down action role-playing game for PC and PlayStation. The site was counting down to Feb. 25, but the countdown clock has since been obscured with a fake emergency broadcast signal.

3D Realms, whose logo appears on the website, exists today in name only, after being effectively closed in 2009. The studio's legal name is now Apogee Software.

The suit, filed in Texas, shows that Gearbox is seeking damages for trademark and copyright infringement, which “stems from efforts to illegally exploit Gearbox’s intellectual property rights in the Duke Nukem video game franchise.”

“You and 3DR are colluding with other, equally-unauthorized parties to develop a new video game based upon the Duke Nukem IP,” Gearbox’s lawyers said in a cease and desist letter to 3D Realms’ CEO Scott Miller. “No developer reveres Duke Nukem and its fans more than Gearbox; it’s why Gearbox committed so much to rescuing Duke back in 2010. As you well know: 3DR’s rights were reduced under the terms of that rescue, not expanded.”

3D Realms’ Scott Miller and George Broussard responded to the letter with a signed document that acknowledges Gearbox’s rights for the Duke Nukem IP. But unless we’re supposed to understand the emergency signal on the teaser website as a cancellation notice, it seems as if Duke Nukem: Mass Destruction is still going forward.

Gearbox’s Steve Gibson told Polygon that the current lawsuit is simply a formality and that he's confident Gearbox will succeed. “We tried to avoid court,” he said.

In 2010, the Borderlands developer announced it acquired the rights for the Duke Nukem IP. It helped see Duke Nukem Forever to the finish line after more than a decade in development, and announced plans to develop other games in the franchise.

"Gearbox was the only home appropriate for the Duke Nukem brand," Broussard said at the time. "They are very talented and possess the perfect perspective and understanding of the brand. Their vision for its future direction is exciting and unbelievable. I personally cannot wait for fans to see their unique take on the franchise."

In 2013, 3D Realms sued Gearbox alleging unpaid Duke Nukem Forever royalties, but then abandoned its claim, and apologized for what it called a “misunderstanding.”

Those games were made before most of today's gamers were even born. They are irrelevant now and there is nothing to revive. Even Duke3D is before most CoD gamers' time. It doesn't carry any cachet as a franchise.

People, Intellectual PROPERTY is just that: property. Just like a car, a house, a gold brick. The law doesn't give a rat's ass what a person DOES with the property they own. You have a legal right to screw up what you own.


If you think that's a bad thing, look at the alternative. Pick your favorite franchise. Now imagine if ANYONE out there, every developer you hate, could make a free to play, microtransaction filled mess of it every year for all time. At once.


The reason they can't is that your favorite developer OWNS your favorite franchise.


Laws are double edged swords.

Secondly there is evidence in the game itself that it was not remade. It referenced and poked fun at movies from years earlier like the Matrix, which were clearly no longer current at time of release. It showed how long the development on the game had been if they had jokes and references to movies that old.

Why would Gearbox let the people who made the reviled DNF make another Duke game if they are planning one themselves at some point? I have trouble seeing a deal come together as Gearbox still gets blamed for 3DR's DNF.

Ironically, both Apogee and GB will both probably stand to gain. Eventually, probably, there'll be a settlement, GB will get paid, and get a piece of the proceed of the game Apogee will develop, and the publicity will sell more games.


That is, unless the litigation drags, the game suffers, it's nine years later when it gets released, and they kill the golden goose. Then the lawyers win and they alone.

<< LINK REMOVED >> They never developed Duke nukem, 3s realms did, they just helped 3d realms finish it by giving them financially backing, a place to work, yes the game isn't great, but it been hyped for 10 years and toot as the best, so people expectations were hi. It also used a very old game engine, I totally agree they should of started from, scratch, i do give them props for finishing the game.

Even though they may not of started or even developed most of DNF, they still financed and supervised the POS. And even after it was completed and they new it was a POS, they still went ahead and released it while backing it with as much hype as possible.


Gearbox has created a reputation of releasing crap to their audiences and utilizing whatever backhand means to sell it. Had DNF been the end of it i would have given them the benefit of the doubt. But then they went ahead and released A:CM under those false pretenses, solidifying their position in my eye's as shameless hacks. The worst part of it all was their narcissistic refusal to acknowledge any wrong doing. No amount of Borderlands 2 DLC will fix their tarnished reputation for me.

Why do you think game studios make games based off movies TV shows, they know they crap, but people will buy it, and those companies pay developers to make this games, it's seed money for bigger and better projects, not every game in a franchise can be awesome, but people still buy it cause they love the grand. Look at COD, and the moutians of repetitive turds it released, yet people still buy it cause they like the brand, sad but true.

They should've let DNF finally die and started from scratch. But knowing Gearbox they probably would've gotten some amateurs to work on Duke Nukem while Gearbox keeps fapping to Borderlands.

Wasn't the last Duke Nukem game a bloated 10 year long mess that went through several engine changes and other large scale problems? I feel like when Gearbox got it, they just wanted to shove it out the door like the 47 year old living with his mom it was. At that point it probably wasn't worth completely fixing. I think they can make a good game if they do it by themselves.

I think they should let this other development team go ahead. I mean it couldn't hurt considering that most gearbox games have had trouble recently. I mean Colonial Marines and Duke Nukem are just two I can think of that really need help. I hate games that hype you up only to be a disaster.
