Game Changes Its Name To Avoid Legal Battle With Bethesda Parent Company

The developers of the indie game Prey for the Gods have announced that they have changed the name of their game due to trademark opposition with the rights-owners for the Prey series, ZeniMax.

In a blog post, developer No Matter Studios (a team of three people) said that it has changed the title of the Kickstarter-funded game to "Praey for the Gods" because it did not want to pursue a legal battle with a huge company like ZeniMax/Bethesda, though it did consider the option "for quite a while." However, it did not feel right to spend crowdsourced funds on something other than development or rewards."

"Something like a trademark opposition can be long and depending on how far someone wants to fight it can be very expensive," the studio explained. "We didn't want to spend our precious Kickstarter funds, nor did we want to have to ask for additional funds to fight this in court. Using backer money towards something that doesn't go towards the development or backer rewards felt horrible to us. Even if we did win we'd have to spend a solid chunk of our funds and in our opinion it wasn't worth it."

The new name is actually one that NoMatter considered prior to releasing the game's first trailer, the studio acknowledged. The team applied for trademarks for both Præy for the Gods and Prey for the Gods.

"Unfortunately, Zenimax chose to oppose our mark, as they felt both were too similar to their mark Prey. While we disagree with their opposition we were able to come to an agreement."

"It was something that kept me up many nights, and no doubt shifted our focus from our game frequently," the statement continues. "Worrying about the outcome if we went to trial, if we'd lose our fans or walk away from the mark and still potentially get sued for millions on trademark infringement. This is really something no starting company should have to deal with let alone a tiny team of three. So the fact that we came out the other end intact still developing the game was a win. One that will no doubt shape our company moving forward."

For its part, Bethesda marketing boss Pete Hines said on Twitter that his company took action so it could maintain control of the Prey trademark, which it owns.

"We really didn't have much of a choice," he said. "If we don't oppose the mark, we risk losing our Prey trademark. We don't really have a choice."

This is not the first time ZeniMax has contested a trademark related to one of its games. In 2011, ZeniMax contested that Minecraft developer Mojang was infringing on a trademark of the Elder Scrolls series with its new game at the time, Scrolls. The case was settled months later, with Scrolls allowed to keep that name, but with its trademark surrended to Bethesda.

The new Prey, the first entry in the series in a decade, launches on May 5 for PlayStation 4, Xbox One, and PC.

In other ZeniMax news, the company was recently awarded $500 million in its lawsuit against Facebook over Oculus Rift.

what scrubs, the indie dev prolly didn't have money laying around to piss away in court, still arkane are well known for mediocrity and I personally didn't like dishonored so never bothered with the second, so I've no interest in prey.

Both Dishonored games have they legion of fans... dont see how Arkane are "well known for mediocrity"... your own opinion is irrelevant when compared to the common opinion, wich is overall positive when it comes to Arkane

Wow i cannot believe that indie studio caved in to changing their creation's name. Prey is a word in the dictionary, and their game is called 'Prey for the Gods' which is original by itself.

If it was me i would have taken them to court and sue them for industry bullying.

Judge:''hey besedha, or however you spell your name, Prey is indeed a word in the dictionary. You are hereby obligated to fund their whole game!''

Troll company suing indie devs now, eh? So any game that has the word "Prey" in it is in violation (Nope)?

To be honest, if he would've replied saying no, I don't believe they would have actually sued them. For example, company "asdf" changed their name to "asdf 1988" and that was fine. To add +3 entire words (1 dominantly different) changes it's entire meaning, in the world of trademarks, from what I've learned - as long as it's distinctively different (which it is). Now, I'm not a trademark lawyer, but I have filed successful trademarks on my own.

Hopefully a nice Trademark attorney offers you some Pro Bono and steps up to bullying on your behalf.

Agreed. My cousins do pro bono work every now and then (my Mom essentially raised them while they did law school when I was a kid,so I know a thing or two myself). But with the indie devs having given up already means it's a non-starter.

This is definitely considered to be a dick move. Would much rather buy the indie game too, looks way better than the trash they pushed out with Prey. Should have kept the previous concept instead, looked much better.

Sounds pretty stupid to me. Kinda like The Evil Within couldn't be named that, because there's a game called Resident Evil. It doesn't seem to matter though as they were already kinda ok with "praey". It's of course a bit less elegant in its double meaning as "Prey for the Gods" would have been.

Then they realized they could get Bethesda to sue them and create a ton of free advertising and changed the name to Prey. Then they kick back and watch the recreational outrage begin.

@soulfulDAGGER: Those are great examples for when the Prey trademark was literally no longer relevant commercially in the video game sector between 2007-2008.

Unfortunately for you Bethesda started owning the trademark since 2013, thus the legal challenges commenced. If Take 2 and 3D Realms still had their Prey game relevant they would have done the same thing, but they let the trademark go years ago and Bethesda snatched it up. Nobody would have stopped No Matter Studios from snatching the same trademark in between those two time periods first, nobody. But they clearly did not exist until years later, so they can wait their turn and stop whining about it publicly by playing a unforced victim role.

@PStrife: Either way, "Prey" is dominantly different than "Prey for the Gods". I honestly believe that, although they're letting it go, they should still file for a registered trademark for "Prey for the Gods" (~$350). I believe the filing attorney would approve it. Nothing to lose for that one - and you can see if it conflicts or not without going to court!

Seriously Bethesda?! You scumbags. Prey For the Gods has a team of 3 (three) people!! You bullies. Did your lizard skin lawyers have nothing to do, so they decided to pick on someone to prove they are worth the millions of dollars you pay them? Did you even look at the product Prey for the Gods? Surely you did. You knew that it was something special, unlike the fodder you published as of late.

I will no longer be purchasing any more of your products. I am removing any and all Bethesda products from my computer and consoles and i urge others to do the same. Go choke on your money, Bethesda. It'll run out soon, before you are bought out by a bigger company. Or the people of planet Earth Kickstart a fund to buy and scuttle companies like yours.

@Myron117: I was speaking in high regards about Prey after playing the demo on the PS4. No more. It's this type of activity by publishers which shame developers and cause distrust. I hope many of the developers leave the clutches of Bethesda in due time.

Because of how the legal system is a big company like Bethesda can bully you into giving up your rights, even if you are in the right and Bethesda is wrong you would have to fight them in court, you would need a lot of money to get lawyers to go up against Bethesda big shot lawyers, small companies can afford this so they have to give in to Bethesda the big bully.

I remember people bashing me for saying that Cyberpunk trademark name will not allow other developers to use it. People called me stupid, so on and so on defending the cyberpunk trademark. Look what happened guys. They are not allowed to use the word prey in order to avoid lawsuit.

@Xatsuna: And they seem to be right so far, since CDPR has never done something like that yet, Cyberpunk is not a common word to have in a title at all, and they made a serious effort to try to explain it was a defensive mechanism against cheap clones or "scam games".

Taking this example from one of the most aggressive companies known for having done this several times and somehow using it as an argument to religiously condemn any trademark ever no matter what it is or who uses it is a rather poor attempt

I'm sorry, a company should not have the right to bully a much smaller one because of a word that's used all of the time. I Love my Fallouts and my Elder Scrolls, but I absolutely HATE when companies pull this bullshit. As long as the title wasn't EXACTLY "Prey" there never should be any fear of any larger company threatening a freaking lawsuit. Real dickhead move by those dickhead lawyers.

What a bunch of parasites. They go out of their way to harass people, potentially damaging their work in the process, when they themselves haven't released a good game in more than ten years through any of their subsidiaries. I know they're on their right to do this, but they should acknowledge their own incompetence and move out of way so that other people may be able to attempt to provide what they so obviously can't.
