Bethesda puts Fallout IP in vault

Three years after landing the rights to the futuristic RPG series, Oblivion developer now owns the property itself; Interplay to continue with Fallout-branded MMOG.

It's been long known that Bethesda Softworks is working on the post-apocalyptic sci-fi role-playing game Fallout 3--which is rumoured to be coming to the Xbox 360--some might have forgotten that Interplay is also planning a Fallout massively multiplayer online game, due in 2010.

According to a Securities and Exchange Commission ruling this week uncovered by fan site No Mutants Allowed, Bethesda has bought the exclusive rights to the Fallout brand, for a sum of $5.75 million. Previously, the company had only licensed the rights to make a game, while Interplay retained ownership of the Fallout IP.

Under the terms of the agreement, Interplay will still be allowed to go ahead with its MMOG game, although "all the rights, titles, and interest" to Fallout are now the sole property of Bethesda. So, in essence, now Interplay is licensing the Fallout MMOG rights from Bethesda.

Under the terms of the deal, the Fallout MMOG will be not playable in a single-player mode or offline in any way--it will require some kind of monthly subscription, and a minimum of 10,000 subscribers. On top of that, the license specifically states that the game must only be for non-console platforms like the PC or Mac, and not use any console online services such as Xbox Live.

The Fallout MMOG might not be out until around 2013, however. The contract states that the project must be commercially launched within four years of the development commencement date, which could start any time within the next two years.

The original game, Fallout, was released in 1997 for the PC as an unofficial sequel to the 1987 game Wasteland. It was set after a series of nuclear explosions had devastated the world and people survived by living in huge underground vaults. A sequel, Fallout 2, followed in 1998, along with various spin-offs, including Fallout: Brotherhood of Steel for the Xbox and PlayStation 2 in 2004.

Can't wait, Bethesda usually do good thing's. So i am looking forward for that. The mmo... sure why not. Can be good, ore it can be abysmal. But its worth a shot, me thinks.

@fastpunk I think you make a very good point, but I would argue that TES approaches storytelling in a different manner, by creating a fully realized world and allowing the player maximum freedom without restraining what happens, thus the player fills in the story - the narrative - whereas in a Final Fantasy or even a masterpiece like Baldur's Gate 2 they tell it to you event-by-event as thought you're reading a novel. TES wouldn't be anywhere near as interesting if they chose to make an interactive novel, like (one of my favorite, if not the favorite, rpg's) Planescape: Torment. The attraction has always been that you have a minimal amount of story burdening you. I think that if Bethesda brings the creativity and skill demonstrated in the best of their in-game short stories and books, then they can definitely create the kind of involved story and well-rounded characters we expect. The possibility remains that they will butcher it, but I'm trying to keep the faith. : )

I love Fallout, and I love the TES series as well. Been playing both series since the very first game. So I'm taking a 'wait and see' approach. In reality, we know next to nothing about Fallout 3 other than it's being developed by Bethesda. AFAIK, there are no screenshots, no plot details, no system specs, nothing except a couple of posters. While I also hope that it doesn't turn into 'Oblivion in the future with guns' there IS one thing that I would like to see come over from the TES series: a robust construction set that gives users the ability to create their own content. Just have a look over at the TES Source web page and look at the thousands of mods available for Oblivion. Now imagine that kind of versatility with Fallout. Specialty weapons and armor, new areas to explore, new factions, new enemies, the list goes on and on. As far as Bethesda getting the license, I think that given the financial condition that Interplay is in and the implosion of Troika, things turned for the best given the circumstances at the time. I'm much happier that Bethesda got the license than I would be if it went to EA or Ubisoft or Atari.

As long as FO3 contains turn-based combat, I have high hopes. That said, I am VERY skeptical of new writers and a new dev doing someone elses IP.

I would agree with maxxorz to a degree... Oblivion was indeed a good game, and Bethesda could indeed make a lot of very good things from the Fallout IP

ghetto. Fallout 2 was awsome...single player, totally open-ended. And you're going to do this to it? MMORPG'S DO NOT have what it takes to make a transition worthy of the game or it's namesake.

Unless you have beaten the original Fallout titles (Fallout 1 and 2), you have no right to talk about the franchise being overhyped. And Fallout 3 will suck. Oblivion with guns *shakes head*

@ fugori: excuse me for asking but what's a story without complex, unique characters? The characters make a story great, it's that thing that makes the difference between good and fantastic. You feel attachment towards characters, not the "world"... Bethesda created some of the best games out there, but they remain games, simple forms of entertainment, they never transcend like Baldurs Gate, Planescape: Torment or Fallout 1 & 2... But as you said, they deserve the chance to prove themselves, as for me, allow me to be skeptic until I see it with my own eyes.

@fastpunk Martin was hardly a flat character, but that's beside the point. I was clearly referring to the side material, such as the in-game books. The Elder Scrolls series doesn't do things in the same manner as traditional narrative-based rpg's, and it's just not useful to compare their "characters" with those of other crpg's which focus on plot. The Elder Scrolls was never about plot, it was about immersing yourself in a world, and creating your own individual story. That doesn't mean they CAN do something like Fallout 3 well, but it doesn't mean that they CAN'T. It simply means that they're untested in this department, and that this will be their chance to demonstrate their abilities with a different style of game.

MMO's blow. I just want a good game, not a game with a subscription fee. I'd play Fallout 3 for PC, but I'd be happier with it on 360. Oh well, can't win them all.

I hope Fallout 3 keeps what it had for the franchise in 1 and 2, like all the insane gore, cool guns, funny and complex characters, lots of humor, and the ability to almost anything. Don't let us down, Bethesda!

@noxian I have to disagree with your assessment of Bethesda's writing. Their writing is top-notch and always has been. What you have to do is look away from the main quest and examine the details - the histories, the books, the smaller conversations and quests. Bethesda's flagship franchise is a unique entity, and I wouldn't expect them to attempt to make an Elder Scrolls: Fallout 3. Of course there is accountability even if you simply license an IP, but it increases with ownership. This story is one of incremental change, but important change. I think it's time that people stopped treating their favorite franchises like their religious beliefs. Give Bethesda a chance.

Noxian, the point is, wait until you even have the SLIGHTEST bit of proof about what STYLE of RPG it is before saying it will be worse than bubonic plague. We have absolutely NO clue how they're making Fallout 3. For all we know, they tried a proof-of-concept Fallout-style game and it worked wonderfully. Or it may have sucked. Maybe they tried an FPS/RPG and it worked out. Maybe it didn't. Nobody but Bethesda knows ANYTHING about this game, so wait until they at least SAY something about it before you declare it a blight upon humanity. SF

Just for starters, Bethesda's writing has never been as good. So you can question what form Bethesda's Fallout will come out as. Not to mention there's history to look at and judge with. and you are very much lying to yourself if you claim to never judge by looking at history since thats one of the basic reasons why we study history in the first place. the times another studio's been able to take another's franchise and create something as good with it have been few and far between. what pains fans even more is that there actually was a Fallout 3 from the original folk that was well into production before politics in Interplay stepped in. @GIF The only new development here is that Bethesda purchased the rights to Fallout as Intellectual Property. So they now own the Fallout franchise in full. The MMO that the article is speaking of was already being developed by Interplay and will continue as such, but now Interplay will owe Bethesda royalties since their positions have been switched. Fallout 3 continues to be in production, developed by Bethesda. You can bet that you'll see another full Elder Scrolls game before Fallout 3, though. Maybe that's just cynicism on my part, but I believe it.

Two additional things to remember: The MMO is still being developed by Interplay, and not Bethesda. Now that Fallout is officially Bethesda's IP, their commitment to the franchise is now solidified. If they do poorly, it reflects directly upon the company. Their future and the future of Fallout is tied, irrevocably. They're no longer dabbling in Fallout - they are Fallout. The possibility exists that this will be a disaster, and that it will be released "when it's finished", but I for one am heartened that they are increasing their commitment to the franchise. I remain quite hopeful. Obsidian isn't the developer. Black Isle doesn't exist any more. It's time to stop living in the past and embrace the possibilities of the future. No one can take Fallout or Fallout II away from us - they are the treasured property of all gamers now, and no matter what we think of Fallout III, they will remain so.

Sure, Bethesda is a good developer but I question their ability to create interesting and complex characters, which was one of Fallout's strong points. This license should have been given to Obsidian Entertainment because after all, they were the ones who developed the original games; of course, back then they were part of Interplay and they were called Black Isle Studios...
